CFFJ PRAISES THE ROBERTS NOMINATION, LAMENTS THE REACTION FROM THE LEFT
Leftist talking points launched against Clement and Roberts virtually identical
July 19, 2005
(WASHINGTON, DC) The Coalition for a Fair Judiciary tonight praised the choice of D.C. Circuit Court of Appeals Judge John Roberts to the U.S. Supreme Court. Kay Daly, president of the Coalition for a Fair Judiciary, said the following:
"The President has kept his promise by nominating someone who will apply the Constitution as it is written. Despite the din from the Left demanding nothing less than a co-nomination, the President made an excellent choice to fill the vacancy on the Supreme Court. Judge John Roberts has the keen intellect, impartiality and temperament, sound legal judgment and highest integrity necessary in a Supreme Court justice.
"The Left, apparently unaware of the outcome of the last two elections, will continue to attempt to dictate to the President the terms of the nomination and confirmation process. The Constitution, however, is clear on that matter which is quite inconvenient to those on the Left who have attempted to mask judicial activists as consensus nominees and any other choice as 'outside the mainstream.' It is nonsense to believe that Senators Ted Kennedy, Chuck Schumer and Harry Reid, along with their pals at NARAL, NOW, the ACLU and People for the American Way have the slightest notion what 'the mainstream' of America believes.
"Quite frankly, it is immaterial whether the nominee is conservative, liberal, moderate, middle-of-the-road or the-chicken-that-crossed-the-road those are political labels that are germane only to the legislative branch and Senator Charles Schumer s ideological litmus test. The relevant questions for any Supreme Court nominee is first, whether or not they are qualified for the position and second, will they apply the Constitution as it is written or will they legislate from the bench using a secret decoder ring to emanate in microscopic penumbras.
"We are hopeful that the Left does not keep up its unprecedented record of obstruction which the American people have soundly and repeatedly rejected at the polls. Given the breathtaking speed with which the temper tantrums on the Left have begun, it is clear that they are deeply disappointed that the President nominated someone who will embrace the Constitution rather than legislate their activist agenda from the bench.
"The most interesting point of Tuesday s rumor-filled day was the release of nearly identical talking points by the Left for Edith Brown Clement and later, for John Roberts. Either the Left has a stunning lack of creativity or a one-size-fits-all rejection for anyone President Bush would have nominated. It proves the Left s vitriol has virtually nothing to do with the nominee and everything to do with how out of sync they are with the values of red-state Americans who elected this President.
"We congratulate the President for the care he took in making this decision. It s a good day for the Constitution."
The Coalition for a Fair Judiciary is a 501(C)4 organization (www.fairjudiciary.com) comprised of more than 100 grassroots organizations dedicated to supporting qualified, capable federal judicial nominees who are committed to fair and accurate interpretation of existing law. Judicial activism, characterized by rulings that create law rather than apply the law, has had a detrimental impact on American society and commerce. We seek to support federal judicial nominees who, in the words of Socrates, will hear courteously, answer wisely, consider soberly and decide impartially."
